CONDEMNATION OF FREEMASONRY BY THE GREEK JUSTICE

DECISION NUMBER 2069 OF 1969

OF THE MULTIMEMBER COURT OF FIRST INSTANCE FOR FREEMASONRY

NECESSARY ADDENDUM

After the third edition of the book, in Athens in 1968

great events occurred,

which are a positive contribution to the general anti-Masonic struggle.

It is now necessary to remind two of them.

We mean the condemnation of Freemasonry by the Greek justice

and its new denunciation by the Church of Greece.

THE CONDEMNATION BY THE GREEK JUSTICE

Freemasonry in 1969, was proclaimed as a religion, and in fact "not known"

also by the Greek Justice.

The opportunity for this was given by the submission of an application

to the Athens Court of First Instance

for the recognition of a Freemasonic Society

under the name "Hellenic Masonic Order Apollo of Delos".

Below are the Minutes and the Judgment of the Court

MINUTES AND DECISION

OF THE ATHENS MULTIMEMBER COURT OF FIRST INSTANCE

MEETING OF NOVEMBER 4, 1969

Composition of the Court:

Subject matter: Association recognition

The Association, founded in Athens

under the name "Hellenic Freemasonic Order of Apollo of Delos",

legally represented by the Board of Directors

chosen by the founders, who are

1) Theodoros Mitropoulos,

2) Dimitrios Tsichlis,

3) Emmanuel Korkidakis,

4) Emmanuel Stylianakis and

5) Georgios Kardamy,

all residents of Athens, except Em. Korkidakis, resident of Piraeus,

attended by the attorney-at-law Emman. Stylianakis.

The meeting was public in front of the audience.

There, after the applicant's name was announced,

he attended as noted above.

In the discussion of the request of the above applicant, dated 26-10-1969,

his attorney-at-law has presented it verbally,

and after he also referred to his written submissions,

he requested its acceptance.

The Court reserved its decision.

EXTRAORDINARY SESSION OF DEC 6, 1969

The court, having been constituted as mentioned above

and after meeting publicly in front of the audience,

published, as the applicant and his attorney-at-law were absent

the following decision, no. 2060/1969.

Because a request comes to be judged

which seeks, according to article 79 and the following of the Civil Code,

the registration of the applicant, under formation, association

under the name "Hellenic Masonic Order Apollo of Delos"

in the unions book, kept by the Court.

The application,

following the legal procedure under Article 794 (2)

of the Code of Civil Procedure,

which is typically accepted and attended

and is properly introduced in the proceedings

of the voluntary jurisdiction before this Multimember Court

(Articles 785 (1) (a) and (833) of the Code of Civil Procedure)

and after it has been investigated, whether it is well founded in law and in its essence.

Because of the provision in Article 19 (1)

of the 1968 Constitution in force

the right is given to the Greeks, to be associated,

in the sense of the establishment of associations, clubs, unions, etc.,

but observing the laws of the State,

and the Constitution, which has an enhanced formal law force.

Article 16 (1), (2) and (4) of the Constitution

the inviolability of freedom of religious conscience is enshrined

and the free exercise of religious duties

by anyone who prefers a known religion,

i.e. an obvious religion, which has no secret doctrine and worship

(see the Opinion of the Supreme Judge 14/15,

Nov. 7, 1277, Saropoulos, c '346, Sgouritsa, b, 152

in Vavoretto's book "The Constitution of Greece 1968" Athens, page 28).

All this under the constitutional limitation of Article 16 (4)

of not infringing, in the exercise of religious duties,

of the public order or of the good morality or the national symbols.

Finally, the Court,

after being asked to approve the statutes of an association,

is obliged under Article 81 (1) of the Civil Code

not to accept the application for registration

of the founders or the administration of the association

in the public book kept for this purpose,

if the purpose or function of the association

is opposed to a prohibitive law,

or good morals

or public order "

Because the under formation association that makes the application

under the name "Hellenic Freemasonic Order of Apollo of Delos"

in the first article of its statutes

it states that "its fundamental basis is to become

the General Principles of the Ancient and Proven Scottish Right Doctrine,

as established by the Freemasonic Tradition,

which is included in the ancient Landmarks (Land Marks)

with the Great Constitutions of 1762 and 1768

and with the ceremonies of it’s various degrees,

but it is not included in its statutes

what is the content of the above General Principles,

the Freemasonic Tradition, the ancient Landmarks,

of the Great Constitutions of 1762 and 1768,

so that the Court can develop full knowledge

whether their content, which is to be the fundamental basis,

of the founding association (Article 1 of the applicant's statutes)

is in accordance with the law or not

(see Article 19 (1) of the Constitution

and Article 81 of the Civil Code).

In view of that

1) the information referred to in Article 2 of the applicant's statutes

that they are the purpose of the founding association,

they do not make known at all to the Court,

the content of the above mentioned in Article 1

Principles, Freemasonic Tradition, etc.,

which are meant to be, as it is said,

the fundamental foundation of the Founding Association and

2) that in Article 3 of the applicant's statutes

it is referred that

"Each member, as a freemason, has an obligation

- to faithfully adhere to the vows he gave

- to preserve the freemasonic secrets entrusted to him

- to keep confidentiality ...,

- to defend with all his might,

the honor and the interests, of the brotherhood to which he belongs ... "

but it is not defined in the Articles of Association in general,

what is the content of the Fundamental Principles, Regulations,

Constitutions, Ceremonies, Freemasonic tradition,

on the basis of which it will be determined

the interest and honor of the brotherhood (the freemasonic apparently)

which the member must defend with all its might

Because the term which is included in the statutes

"to defend with all his might"

may possibly lead,

if the association of the applicant is recognized by the court,

to an illegal activity of the same or its members,

which does not recognize any limit ("with all its powers")

and which is determined by data unknown to the Court

and is an obligation of the members,

and for this, the association is contrary to the law.

Because otherwise and regardless of the above

from the entire content of the statutes

of the applicant under the formation union is clearly established,

in the court’s judgement,

which according to the provisions of articles

789, 805 (3) and 352 (1) of the Code of Civil Procedure

takes account of the knowledge,

which is drawn on the findings of common experience and perception

(judgment of Supreme Court 647/1967)

that this association seeks to disseminate the principles

of Freemasonry,

which is not a philosophical system but a religion,

in the sense of all the beliefs,

of faith in one or many gods,

along with external types and ceremonies, etc.,

with whom faith and worship to the divine are manifested.

That Masonry is a religion,

was accepted, both by the Church of Greece,

and also by the State, indirectly, but clearly.

Thus, the Hierarchy of the Church of Greece

at its meeting on 12 October 1933

under the presidency of then Archbishop Chrysostom Papadopoulos

unanimously voted

that "... Freemasonry is proven to be a religion

completely different, separated and alien to the Christian religion,

as it is obvious, beyond reasonable doubt

and by having its own temples, with altars,

which the masters of the Freemasons classify as workshops,

which can not be inferior to the history and holiness of the Church

(G. Sokou, Pythagoras Z, pages 19, 20)

and as temples of virtue and wisdom,

in whom the supreme Being is worshiped

(the Great Architect of the Universe)

and the truth is taught "

(Freemasonic manual page 27).

In addition, the Hierarchy of the Church of Greece accepts

that Freemasonry

has its own religious ceremonies, which are

- the adoption of a baby wolf ceremony or freemasonic baptism,

- the marriage recognition ceremony or freemasonic marriage,

- the freemasonic memorial,

- the inauguration of the freemasonic temple, etc.,

that it also has

- it’s own initiations,

- it’s own ceremonial rituals,

- its own hierarchical order

and the same conclusion could be drawn

- and from freemasonic loves (symposia),

- and from the celebration of the two solstices, the winter and the summer one

with religious symposiums and common wisdom,

that (Freemasonry) is a religion ... "

On the other hand, it was accepted

that the religious character of Freemasonry

appears exceptionally clean,

as in their lodges, workshops and temples

worship takes place,

that is, respect towards their God, manifested by words and actions

which (worship) is the characteristic of every religion,

furthermore freemasonry is worshiping a Supreme Being (God)

the Great Architect of the Universe, as it is called by the Freemasons

page 11 of the Freemasonic Bible

and see also Freemasonic Ceremonies, Page 72

in the book of Epiphanios Theodoropoulos, "Freemasonry in the Light of Truth"

Athens 1968, 3rd edition, pp. 13 and 83.

But it is generally well known on a global scale,

that Freemasonry is a religion,

in such a way that, due to this property,

all Christian confessions

(Western Church, Lutheran, Methodist and Presbyterian Communities),

like the Orthodox Autocephalous Churches,

declare that this religion is incompatible with them.

Finally, the state, as has been said, implicitly but clearly,

accepted the religious property of Freemasonry.

Thus, in the 6th year of Primary School textbook

of the course of Occupation-Church operation

by Leonidas Christofilopoulos - Christos Karytinos Mitsis, of the year 1969

on page 85, titled "Freemasonry"

it is explicitly stated that "Freemasonry is a religion".

But freemasonry is not a known religion, in the mentioned sense,

but it is a religion that is not apparent, it has secret doctrines and worship

and which is a secret organization, unknown in the content,

not only to the many, but also to those who are freemasons,

due to the last initiations from one degree to the next,

in such a way that he, who belongs to a lesser degree, can not know

those secrets, which one knows who belongs to the superior degree

of the thirty-three (33) degrees in total, of the freemasonic hierarchy.

For the character of Freemasonry, as a religion not known,

the Hierarchy of the Church of Greece declared, as stated above,

which characterized Freemasonry as a mystical system,

for the reasons noted in its decision.

And the book of the 6th year of Primary school, which we reminded,

characterizes freemasonry as a "secret organization of persons," on page 84.

On the other hand, the book "Freemasonry," by P. Trembellas, on pages 46-47,

exposes the secret nature of the Freemasonic religion.

That Freemasonry is a religion, not known, is proved by:

- Articles 4, 14, 15 and 16,

of the Constitution of the Grand East,

- from Article 37 of its Ceremony for the First Symbolic Degree

- from Article 65 of the General Regulation of the Grand East

(all of which are official authentic texts of Freemasonry,

see in the book of Epiphanios Theodoropoulos,

"Freemasonry in the Light of Truth", Athens 1968, 3rd edition).

Because, therefore,

since it has been established in the Court’s judgement,

that the association under formation,

under the name "Hellenic Masonic Order of Apollo of Delos"

seeks the dissemination of Freemasonry among its members and, in general,

which is a religion not known,

and because of this, unprotected

from Article 16 (2) of the 1968 Constitution,

the request of its founders for registration in the relevant public book,

which is judged today, must be rejected,

since its purpose and function

is contrary to the said provision of the Constitution,

regardless of the fact that the worship,

practiced by the followers of freemasonry,

the development and dissemination of which, as mentioned,

it is clear from all the contents,

of the applicant's statutes,

that the requesting association seeks,

in view of its secret organization in general,

is contrary to the good morality,

ie the set of rules,

which the morality dictates,

the one that regulates modern social living,

furthermore it is contrary to the public order,

and for these additional reasons,

the application must be rejected.

IT IS HELD

that the application is rejected.
